Lifetime Workmanship Warranty

Terms:
Unless the context indicates otherwise, as used in these Terms, (i) “High West Siding and Windows, Inc.”, “High West”, “us,” “we” and “our” refer to High West Siding and Windows, Inc.

Warranty:
The term “Lifetime” means the named homeowner who is the original purchaser of High West Siding and Windows, Inc. products and installation services. The term of the “Lifetime” period shall remain in effect only if the original purchaser remains as the owner and primary occupant of the residence on an uninterrupted basis. This Lifetime Workmanship Warranty expires upon the sale of the residence, the designation of the residence as investment or rental property, or if the original purchaser is no longer the resident of the property. This Lifetime Workmanship Warranty is non-transferable.

What Is Covered:
This Lifetime Workmanship Warranty covers installation according to established industry standards and covers defects caused by improper installation and or damage to the products while being applied that are caused by the installation crew.

In the event of a valid warranty claim, High West will furnish labor to repair any defective installation workmanship. We will also supply replacement materials when necessary to make such repairs. High West reserves the right to substitute materials that it believes are of equal value if materials identical to those originally installed are no longer readily available to us when such repairs are performed. All replacement work and materials will be provided solely by High West Siding and Windows, Inc. or by parties designated by High West Siding and Windows, Inc. The homeowner may not contract with another to provide such labor or materials unless otherwise directed in writing by High West. Repairs undertaken by the homeowner or third parties without the written approval of High West Siding and Windows, Inc. will void this warranty.

What Is Not Covered:
Product defects and a number of damage exclusions under this Lifetime Workmanship Warranty will be covered under your products manufacturers’ warranty. Damage caused by acts of God should be covered by your homeowner’s insurance. This warranty does not cover damage related to acts of God, weather conditions, storm damage, fire, flood, earthquake, moisture, water, humidity retention or accumulation, mildew, mold, settlement or deterioration of the building structure, improper care, adverse effects of pollution, normal surface wear, accidental or intentional damage, manufacturing defects, failure of materials, or any cause beyond High West’s control. In addition, this Warranty does not cover routine maintenance (e.g., caulking, cleaning). HIGH WEST SIDING AND WINDOWS, INC. WILL NOT BE LIABLE IN ANY EVENT FOR CONSEQUENTIAL, INDIRECT, OR INCIDENTAL DAMAGES OF ANY KIND, INCLUDING DAMAGE TO THE INTERIOR OR EXTERIOR OF ANY RESIDENCE WHETHER FOR BREACH OF THIS WARRANTY, NEGLIGENCE, STRICT LIABILITY IN TORT, OR FOR ANY OTHER CAUSE. The total liability of High West for claims under this warranty shall be limited to, and in no event shall exceed, in the aggregate, the total installed cost of the home improvement products originally installed by High West Siding and Windows, Inc.

How to File a Workmanship Warranty Claim:
To file a Workmanship Warranty claim, you must send written notice of the claim, a copy of your original High West Siding and Windows, Inc. contract, and a picture of the alleged defect, within 30 days after your discovery of the alleged claim.

ALL OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANT ABILITY, HABITABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HERBY DISCLAIMED.
